Controversies and Legal Matters
[edit]Racemax Trademark Dispute
On February 28, 2023, ASTN President Roger Neal Smith filed an application with the United States Patent and Trademark Office (USPTO) to register Racemax, a proposed television series. The USPTO examining attorney found no conflicting marks, and the application advanced to publication in the USPTO Gazette.
On November 10, 2023, Home Box Office, Inc. (HBO) filed an opposition, claiming that Racemax would cause confusion with its family of “Max” trademarks, including HBO Max.[1] Smith represented himself in the matter, arguing that HBO had no racing-related trademarks and that Racemax was distinct from HBO’s marks.
On July 8, 2024, HBO withdrew its opposition, and the USPTO’s Trademark Trial and Appeal Board dismissed the case with prejudice[2], allowing All Sports Television Network to retain its application.
