Scrap Service Company (formerly known as Pielet Brothers Scrap Iron and Metal or simply Pielet Bros.) is a scrap company based in the Illinois state, the company was founded and operated by Arthur Pielet from its inception date, 1947, until 1986,[2] the company had three scrapyards in five divisions, these five divisions were the Arlington Heights division in Arlington Heights, Illinois, the Chicago division in Chicago, Illinois, the Joliet division in Joliet, Illinois, the LaGrange division in LaGrange, Illinois and McCook division in McCook, Illinois.
History
[edit]The company was organized in 1947, as Pielet Brothers Scrap Iron and Metal Company,[1] and from 1954 onwards, the exclusive scrapper was used by the General Motors Electro-Motive Division (EMD) when they started their locomotive trade-in program,[3] the company also made trade-ins from General Electric (GE).[4]
Pielet Bros. had made a contract with the Luria Brothers Scrap Company to sell 35,000 tons of scrap steel from dismantled barges. Pielet argued that no enforceable contract existed and that any agreement was contingent on receiving the scrap from a third-party supplier. On April 4, 1978, Luria filed a lawsuit against Pielet for breaching that contract, and on June 18, 1979, the jury of the Illinois district court found the favor of Luria Bros., awarding Luria a total of $600,000 in damages.[5]
In December 1986, Arthur Pielet sold his interest to his sons James Pielet and Robert Pielet.[6] As part of the sale, Arthur was promised a lifetime consulting fee, and after his death, the same fee would go to his wife, Dorothy Pielet. The agreement stated it was binding on successors and assigns. The original company dissolved in 1994, but payments continued until 1998. When the successor company Midwest Metallics had faced financial trouble and filed for bankruptcy in 1999, payments had stopped. As a result of all of this, Dorothy had filed multiple lawsuits against multiple successor entities for breach of contract and successor liability.[6][7]
