I believe this image qualifies as fair use because:

  • the photograph succinctly illustrates the effect of Minamata disease on the human body
  • the historic photograph of Tomoko Uemura's crippled hand cannot be reproduced (Tomoko died in 1977)
  • the image is of low resolution and will not damage the copyright value of the original photograph
