Image is used in the infobox/header to provide visual identification of the subject of the linked article. This image is being used for identification of a deceased historic figure who is the subject of an article written for nonprofit informative purposes. It is believed that the use of the image on Wikipedia will have no impact on the commercial value of the image or any other works it is currently used in. It is held that the use of copyrighted images of individuals that are no longer living, are inherently unrepeatable, and where no new free-use image is available is permitted under US copyright law governing the fair use of copyrighted properties, and Wikipedia fair use policies. The subject of the photo died in 2005, therefore a new free image of the subject cannot be created. Should a 'free' image of tue subject taken during his lifetime exist then this image should be replaced. |
